Fees for Criminal Defense

Generally speaking we charge flat fees for our criminal defense services.  The flat fee includes representation from arraignment through sentencing including all pre-trial hearings and motions; however, it does not include representation at trial. We charge a separate fee for defense at jury trial. Jury trial fees vary widely depending on the complexity of the case but generally our trial fee is at least as much as our fee for our pre-trial services.  Statistically, only 5% of criminal cases proceed to trial and for this reason we charge for our trial fees separately.  Below is a list of the minimum fee or fee ranges we generally charge but fees vary from case to case.  All fees for criminal defense representation assume case is pending in Jackson County—fees may be higher for out-of-county work.  We do not generally offer payment plans for criminal defense matters and payment in full is due at the time we are retained. General Misdemeanor Defense - $750-$1500

  • Includes all misdemeanors with maximum sentences of 180 days or less.

Serious Misdemeanor Defense - $1500-$2500

  • Includes all misdemeanors with maximum sentences of 180 days or more

Driver's License Restoration - $1500-$2000

  • Includes appeal to circuit court if necessary

General Felony Defense - $2500-$5000

  • Includes all felonies with maximum sentences of 15 years or less without consideration of habitual offender notice.

Serious Felony Defense - $5000 +

  • Includes all felonies with maximum sentences of more than 15 years without consideration of habitual offender notice.

Standard Fees for Immigration Services

We charge a flat fees for most all of our standard services so you know what you will pay upfront--no surprises. In most cases, our fee is paid in one or more installments at significant bench marks in your case which spreads the cost of our services over the course of the immigration process. Our standard fees are listed below.  These amounts represent the fees we charge for a routine case.  Some cases involve extraordinary circumstances and may require substantial additional work.  Similarly, some cases are unusually simple and in those cases we may offer a reduced fee. We also will generally offer a reduced a package rate fee for cases that involve more than one family member immigrating at the same time. We will advise you after evaluating your case if any circumstances exist which would require us to deviate from our standard fees.  The fees list below DO NOT include appeal of denials, any required waiver applications or representation at consular or USCIS interviews unless specifically indicated.  We represent clients in additional immigration matters that are not listed here.  If you require representation for something other than what is listed here please contact us for a fee quote.

In general, we do not accept cases which are not approvable or have an extremely low likelihood of approval.  We screen these cases out during the case evaluation process.

Criminal Defense Support

Case Review & General Counsel - $750 minimum

We assist other criminal defense lawyers who represent individuals charged with a crime who are not U.S. citizens. The U.S. Supreme Court, in Padilla v Kentucky, held that failure of a defense attorney to advise his client of the potential negative consequences of a criminal conviction on his immigration status is ineffective assistance of counsel. Determining whether or not a certain criminal conviction will have negative consequences for your non-citizen client can be difficult and often there are no clear cut answers. Mr. Curtis regularly advises other defense attorneys regarding immigration matters and assists them in meeting the professional requirements set forth in Padilla. Because Mr. Curtis is also a criminal defense attorney he can assist in developing defenses or fashioning plea agreements which will minimize the potential immigration consequences for your non-citizen clients. While in many cases defense counsel will not be able to obtain a result that does not have negative immigration consequences, Padilla only requires that the defense attorney inform the client of the potential negative consequences. Mr. Curtis can help you rest easy at night knowing you have met your obligations under Padilla and reduce your exposure to malpractice claims and Ginther hearings.

  • Fees for our immigration services are generally accepted in 2-3 payments over the course of the immigration process. Filing fees are due when incurred and we do not offer payment plans for file fees.

  • Payment plans are not generally available for criminal defense.
